What Is Domestic Violence?
Domestic violence can be physical, sexual, emotional, economic, or psychological harm intended to intimidate or influence a domestic partner.
A domestic partner can be:
- A spouse
- An ex-spouse
- Someone you have a child with or are expecting to have a child with
- Someone you live with or have lived with in the past
- Someone you are dating or have dated
Domestic violence consists of actual or threatened harm and is covered by the Prevention of Domestic Violence Act (PDVA) which was established in the State of New Jersey in 1991. Under the PDVA, 14 different crimes are prohibited as domestic violence offenses, some of which include:
- Sexual assault
- Harassment
- Stalking
- Criminal sexual contact
- Criminal mischief
- Burglary
- Criminal trespass
- Criminal restraint
More recently, in February 2024, New Jersey courts have added “coercive control” to the list of actionable offenses. Coercive control can encompass things like financial abuse, isolation, intimidation, and surveillance.
How Can I Win a Domestic Violence Case?
If you are a victim of domestic violence, you can seek a restraining order to protect yourself and your loved ones. You may also file a civil lawsuit seeking damages for medical bills, pain and suffering, and other expenses related to the abuse. Finally, you can seek to have the abuser’s custody and visitation rights modified by the court.
If you have been accused of domestic violence or feel someone has unfairly requested a restraining order against you, we urge you to seek legal representation to protect your rights and interests.
